They're only available to defenders. To get in them, just move on top of them. Your men dig them automatically at the positions where you set them up. You can fit a squad in each. The cunning defender will split his squads on setup - each team then digs their own foxhole, doubling the number available.

Hi Ned,
Defenders get foxholes and attackers don't. The holes are placed wherever a squad/team/gun is located when the set-up phase is completed. (Exception: no foxholes in buildings, roads, rough, or marsh.)
You can't create foxholes during a game. However, it is possible to nearly double the number of holes created during setup by splitting all your infantry squads. Each half-squad gets its own hole, and you can always re-join them during the game's early turns.
If I'm not mistaken, one side in a meeting engagement is still technically the "defender" (as per the game set-up screen), and that team will have holes at the start.

A commonly used trick with troops you plan to have in buildings is to place them on setup a short distance BEHIND the building. Then they'll dig a foxhole & you can move them into the building on the first turn. But they'll have a foxhole in case the need to retreat later on. (Behind, not in front, so attackers can't benefit from the foxhole.)
